
A locked gate preventing access from Whitworth Crescent through the Riverdene development to the waterfront, is reportedly preventing both legal access, and anti-social behaviour.

While residents at Riverdene in Whitworth Crescent assert a locked gate linking the street to the river helps prevent anti-social behaviour, others are campaigning to maintain waterfront access. Meanwhile the Council is discussing ways that could enable the gate to be locked at night only (SCC PDF download 46mb — search for Item 15).

I have now received a letter from Karl Collymore, Planning Enforcement Officer at the Council, saying that "...Officers have kept the matter under review and have decided to re-present a report to members of the Planning and Rights of Way Panel." (Dated 16th November)

The Panel meeting was due to take place on 23rd November, but I received a second letter, dated 18th November, saying that the re-presentation had been withdrawn "...following advice from Legal Services...It is first necessary to write to the freeholder of the land to appraise them of the situation. Once a response has been received back from the freeholder, the matter will then again be reported back to the panel."
I am currently waiting for a new date for the Rights of Way Panel meeting at which this matter will be discussed. I have been invited to attend, as have others who have been involved. Anyone else with an interest, not on the Council's list, should also be able to attend and, if they wish, make a representation to members of the panel who will decide whether to take any formal enforcement action in respect of the Section 106 Agreement.
